Terms of Use

These conditions govern every visit, search, and use of Brooke County Criminal History. By continuing to use the website, a visitor accepts all terms below. Anyone who does not accept them must stop using the site.

NO FCRA USE. This privately operated website is not affiliated with government and is not a consumer reporting agency. Neither the site nor its advertising partners provides a service for any purpose regulated by the Fair Credit Reporting Act, including credit, employment, tenant screening, or insurance decisions. It is a reference resource for Brooke County and West Virginia criminal-record channels, not a private investigation firm.

1. What This Website Is

Brooke County Criminal History is a private reference site with no government affiliation. It neither stores official criminal records nor retrieves records, performs official background checks, or files documents.

Its content directs readers to the Brooke County Sheriff Department, county courts, West Virginia State Police Criminal Identification Bureau, WVDCR, and West Virginia State Police Sex Offender Registry. Outside search tools may also be linked. Access to nonexempt public-body records is governed by the West Virginia Freedom of Information Act, W. Va. Code §29B-1-3, with exemptions in §29B-1-4; that public-records law does not turn this private site into a government custodian.

2. Rules for Using This Site

Every visitor agrees not to:

  • Violate federal, West Virginia, or local law
  • Harass, threaten, stalk, or intimidate another person
  • Use information for any FCRA-regulated decision
  • Seek unauthorized access to systems or data
  • Operate bots, scrapers, or automated collection tools against the site
  • Disrupt performance or another visitor's access

3. No Harassment, Stalking, or Discrimination

Information from this site or a linked tool may not be used to harass, stalk, threaten, intimidate, or discriminate. Misuse can violate law. The West Virginia State Police Sex Offender Registry is provided for public safety, not retaliation or vigilantism. West Virginia Code Chapter 15, Article 12 and the registry warning govern lawful handling of that information.

4. We Are Not a Consumer Reporting Agency

This site does not create a consumer report, credit report, or background-check product and is not a consumer reporting agency under the FCRA. Visitors must not use data from this site or a linked tool for:

  • Credit or lending decisions
  • Employment decisions
  • Tenant screening or housing decisions
  • Insurance eligibility or pricing
  • Licenses, permits, or government-program eligibility

Any legally authorized check must be obtained through an appropriate official or FCRA-compliant provider. West Virginia State Police dissemination is separately governed by W. Va. Code §15-2-24.

5. No Legal Advice

General information about Brooke County records is not legal advice. A licensed West Virginia attorney should address how any charge, warrant, conviction, or expungement provision applies to a particular case.

6. No Warranties

All content and services are provided "as is." No warranty is made that:

  • Information will always be complete, accurate, or current
  • The website will remain continuously available
  • Pages will be free from defects or security weaknesses
  • A partner search will return complete or correct results

Criminal records can be filed, changed, sealed, or expunged. Content here is not an official statement by a Brooke County office or West Virginia agency.

7. Third-Party Services and Links

External links may lead to government portals, legal resources, and search providers. This site does not control their content, availability, prices, terms, or privacy practices and accepts no responsibility for them. Users should review the destination's rules.

8. Intellectual Property

Unless otherwise stated, site text, graphics, logos, and code belong to Brooke County Criminal History or its content partners. Copying, modifying, distributing, or creating derivative work requires prior written permission.

9. Limits on Our Liability

To the fullest extent permitted by West Virginia law, the site is not liable for losses or damages arising from use of its content, operation, or a linked service, including reliance on information found through them.

10. Indemnification

A visitor agrees to defend and hold the site harmless from claims, demands, proceedings, fees, and costs caused by that visitor's use of the site or violation of these terms.

11. Governing Law

West Virginia law governs these terms. A dispute tied to site use must be brought in a court with proper jurisdiction in West Virginia.

12. Changes to These Terms

The terms may be revised at any time. A revision becomes effective when the updated text is posted on this page.

13. Cutting Off Access

Access may be restricted or terminated at any time, for any reason, and without advance notice.

14. Severability

If a court finds one provision invalid or unenforceable, all remaining provisions continue in force. The affected provision will be adjusted only as far as needed to make it enforceable.

15. Questions

Questions about these conditions may be directed through the Contact page.
