Brooke Case Numbers Can Split

The letter M marks Magistrate Court, the code 05 identifies Brooke County, and a type segment may mark a misdemeanor. Treat that code as a route, not the result. If a serious charge appears, give both the magistrate number and the approximate year to the Circuit Clerk. Ask whether a related Circuit file exists.

The public magistrate detail may also show bond type, amount, reduced amount, status, payor, and receipt fields. A blank sentence section can read “NO SENTENCES.” That does not prove a linked Circuit Court file has no sentence.
Read Brooke Criminal Case Results
Three terms prevent common errors in Brooke County court research. A disposition is the outcome of one charge. A dismissal ends that charge without a judgment of guilt. A nolle prosequi means the prosecutor chose not to continue that charge at that time. None of those labels should be applied to the whole case until every count is checked.

Call first. A certified judgment from the clerk carries more authority than a screen capture from a search result.

Access Rules for Case Records
West Virginia public access is broad but not absolute. W. Va. Code §29B-1-3 permits inspection and copying of nonexempt public records and sets a five-business-day response rule for FOIA requests. Yet a police FOIA request is not the route to a court-certified judgment. Ask the clerk for court records. Use FOIA for an identifiable sheriff or city agency record when no normal request route resolves it.
Section 29B-1-4 protects specified law-enforcement, privacy, security, and confidential material. Juvenile cases, sealed or expunged files, protected victim data, personal identifiers, exhibits, and parts of active investigations may be restricted or redacted. An empty web result can also reflect an old paper file, a spelling issue, or the wrong court. Ask the known custodian before drawing a conclusion.
Federal Cases Outside Brooke Courts
